Is There a Helmet Law in Illinois?

If you ride a motorcycle in Illinois, and would like to know if you must wear a helmet, the answer is NO. Illinois does not require you to wear a helmet. In fact, Illinois is one of only 3 U.S. states that does not require motorcycle helmets. The other two states that do no require helmets are Iowa and New Hampshire.Furthermore, Illinois helmet laws do not require helmets for any type of low-power cycle (LPC), including mopeds, scooters, and any other cycle with a top speed of 30 mph or less. However, if you ride a motorcycle or LPC, it is highly recommended that you wear a protective DOT approved helmet. When accidents occur, helmets are proven to be effective is saving motorcyclists’ lives. According to the National Highway Traffic Safety Administration, helmet use among fatally injured motorcyclists is well below 50%.If you have been in a motorcycle accident due to someone else’s negligence, then you may be eligible for compensation in an Illinois motorcycle accident claim, even if you were not wearing a helmet.
