1. Where are workers' compensation claims heard?
The Illinois Workers' Compensation Commission is the body that adjudicates all workers' compensation claims in Illinois. There is no filing fee for filing a workers' compensation case.
2. Why do I need an attorney if the Commission can handle my claim?
An attorney is an advocate for injured parties. Our job is to make sure your claim is handled correctly, fairly, and in a timely manner and that you receive the benefits you deserve. The Workers' Compensation Commission encourages injured workers to obtain the services of a lawyer to safeguard their rights under the law.
3. How can Attorney Barry Doyle help me get benefits?
During your free consultation, Mr. Doyle will let you know what he can do for you. We will work closely with your doctors to make sure you receive the care you need and the benefits due to you.
One of the most common complaints with workers' compensation benefits is that even when they are approved, they are slow in getting your first payment out. Mr. Doyle knows how to navigate the system to secure the payments you need when you need them. Schedule your free consultation with us today.
4. How long until my Workers' Compensation case is resolved?
According to the Illinois Workers' Compensation Commission, "Once a claim has been filed, the case is set on a two-month cycle. Every two months, the case is set for an arbitrator's status call. At the call, the parties may request a trial or offer a settlement agreement. If no action is taken, the case is continued for another two months. This rotation continues for three years. At that time, the case may be dismissed unless the parties show there is a good reason to continue it."
The vast majority of disputes at the Commission are settled without ever going to trial. On average, a settlement is approved about one and a half years after a claim is filed. The length of time you will have to wait before getting actual benefits can be greatly reduced with the help of the Law Offices of Barry G. Doyle, P.C.
5. What do I do if my benefits were approved a while ago but I haven't received a check yet?
If the payments are late, we may be able to get you additional penalties and fees to compensate for the delay.
