If someone else is to blame for my construction accident injuries, am I limited to worker's compensation?

A: No. If there is someone else to blame for your construction accident other than your employer or a co-employee, then you can also file a third party liability lawsuit against the persons or companies responsible for your injuries. It is called a third party liability suit because there is a third party besides yourself and your employer to blame for your injuries. You do not have to choose between filing an Illinois worker's compensation case and a third party liability suit. You can pursue both.
