How will the property damage from my car accident be taken care of?

 

A: There are two basic options, short of simply paying the money out of your own pocket to have your car repaired. 

The first of these options is that you can submit it to your own insurance, if you had collision coverage.  Your insurance will be pay the costs of the repairs, less your deductible.  If the other driver was at fault, one thing that your insurance company will do is sue the other driver to recover the full cost of the repairs, including your deductible. 

The other option is that you can submit the bills for payment with the other driver's insurance.  This can sometimes be a problem if they are not accepting liability, if they are disputing the extent of the damage caused by the collision, or if they are insisting that you use "their" body shops.

Unfortunately, the process of getting your car repaired well and quickly is often a less than satisfying process.  Our firm does not get involved in property damage disputes, as we have found that in practice we are in a poor position to help the clients get their cars fixed quickly, which is often an important objective.
