Q: Are punitive damages available in wrongful death suits?
A: No, Illinois law does not allow punitive damages to be recovered in wrongful death suits. Once a person passes away -- even for reasons unrelated to the accident -- the opportunity to pursue a punitive damage claim is no longer available.
