Kankakee sidewalk fall settlement

We were able to reach a settlement on behalf of a woman who fell on a defective city sidewalk outside the Kankakee Post Office. Liability was established through testimony from postal employees that there had been a number of falls caused by defects in the sidewalk during the years prior to the client's injury and that these incidents had been reported to the City. The key issue in the case was proof of the extent of the injury as the client had 2 prior back surgeries which the defense argued was the real cause of her difficulties following her fall. We focused on the documentation of the extent of her recovery from those earlier back injuries as well as documented differences between her pre-existing conditions and the conditions found after the accident.
