A lot of working people in Chicago turn the Labor Day holiday into a four-day weekend by using a vacation (or sick) day on the Friday before the first Monday in September. For these people, Thursday was the last day of the work week (and work month). But motorists heading into Chicago Thursday morning on the Dan Ryan Expressway may have gotten caught in a major traffic jam due to a fatal Chicago motorcycle accident.
According to authorities, a 1996 Yamaha motorcycle was reportedly driving at a high rate of speed in the inbound local lanes of the Dan Ryan about 5:15am. Near Pershing Street, a slow-moving 2002 Cadillac tried to change lanes in front of the bike, and the Yamaha struck the rear of the car. The 43-year old Chicago man driving the motorcycle was pronounced dead at the accident scene, which was just across the freeway from U.S. Cellular Field. Neither the 16-year old boy driving the Cadillac nor any of his passengers were hurt.
Normally, a vehicle which strikes the rear of another is fully at fault in the accident. However, police ticketed the teen for driving below the minimum speed limit and driving without a license. So there’s a possibility that the teenager might be assigned part of the blame for the fatal Chicago motorcycle accident. While witnesses claimed the motorcyclist was traveling “at a high rate of speed,” the fact that the Cadillac was driving slower than legally allowed might have made it appear that the bike was speeding.
If an investigation reveals that the 16-year old was partially responsible for the crash, the surviving family members of the 43-year old Chicago man may choose to file a wrongful death lawsuit in the hopes of collecting damages for burial expenses, lost future wages, and/or pain and suffering and loss of care and companionship.
