Logging truck roll-over criticially injures one

A New Hampshire man was critically injured when a logging truck rolled over.  The logs crashed onto a pick-up truck, trapping the driver of the pick-up truck.  He was seriously injured and had to be cut out of the pick up truck and has had to undergo surgery for the injuries he suffered.

There are a limited number of reasons why a tractor-trailer roll-over accident would occur.  Generally, these include:

• The trailer was improperly loaded, meaning that the load was either not secured properly or the load was unbalanced so that when the truck turns, its center of gravity moves so far to one side that the trailer tips.  Drivers are required to inspect the load before going out onto the road to make sure that the load has been safely put onto the trailer;
• The truck driver was speeding; or
• The truck driver hit an object which caused the trailer to tip over.

The bottom line is that there are a limited number of reasons that a tractor trailer would tip over, and virtually all of them are under the control of the driver.  The only real exception to this is when the truck driver is shipping a sealed (locked) load and cannot inspect the load before going out on the road, and in that case, responsibility for safely loading the trailer falls on the shipper.  In any kind of tractor trailer roll over accident, an experienced Chicago personal injury lawyer would know investigate this issue and identify the shipper well before the statute of limitations for a trucking accident expires.
