Infant among the injured in car crash with uninsured motorist

An Urbana infant was among four injured in a car crash near Tolono last Friday that happened when an uninsured driver ran a stop sign and hit a van being driven by a man from Homer that was passing through the intersection.  The infant was a passenger in the van which caught fire as a result of the collision.  The driver who ran the stop sign was cited for no insurance.

This fact pattern reveals a quirk in the law regarding Illinois uninsured motorist claims.  When you are involved in a crash with an uninsured motorist, you are covered by the uninsured motorist policy on the vehicle you were in at the time of the accident.  You are also covered on any other policy issued to a person with whom you are a resident relative, meaning that you live with them and are related to them.
