Enforcement of the Illinois Mandatory Insurance Law

If you own and operate a vehicle in the state of Illinois, you are required by law to carry a minimal amount of liability insurance, also known as Illinois Mandatory Vehicle Insurance. The purpose of the insurance is to help protect you from costs that you may incur as the result of a car accident.

Most vehicle operators are probably aware of this minimal requirement, but they (and you) may not be aware of how this law is enforced.

The Illinois Mandatory Insurance law is enforced through two paths. The first is fairly obvious. If you are stopped for a traffic violation or involved in an accident, the officer at the scene will ask for your license and registration.  If you are proven to be uninsured, you will be ticketed for operating an uninsured vehicle. A conviction will be submitted to the Secretary of State for suspension of your registration and a 3-month driver's license suspension.

You may not be aware of the second method for enforcement of the Illinois Mandatory Insurance law. A random selection process is performed through the Mandatory Insurance Division of the Illinois Secretary of State Office.

The computer randomly selects names from their database of license plate registrations. If your name is selected, you will then receive an insurance verification form from the office. Your liability coverage will be confirmed through your insurance company. If you fail to have the minimal Illinois Mandatory Vehicle Insurance, or you do not return the form, the Office will suspend your license.

Illinois Mandatory Vehicle Insurance is a necessary protective measure for consumers. If you are involved in an auto accident, a Chicago personal injury lawyer can help you work through any complications arising as a result of inadequate coverage of involved parties.
