

During the initial filing of your Chicago personal injury claim the defendant will have the option to file a counterclaim against your complaint. This is basically turning the tables on you, with the defendant filing their own claims against you in respect to your accident. The counterclaim may or may not admit that your claim is valid. In many ways, it's the equivalent of "Yes, but..." wherein the defense tries to justify their actions in regards to the claim.
For example, let's say you slipped and fell near your neighbor's pool and suffered a traumatic brain injury and spinal injuries. Your claim is that the neighbor failed to keep their deck area safe and that resulted in your severe, life-alerting injuries. The defense (your neighbor), may file a counterclaim saying that you were running and your improper behavior around the pool caused your injury.
You may respond to a counterclaim by filing a "reply to counterclaim," which acts much like the Answer the defense had to file. In the Reply, you admit, deny, or assert a lack of information in regards to the counterclaim.
