A 9 year old girl from Chillicothe was seriously injured when the ATV on which she was a passenger flipped over and struck a tree. The woman who was driving the ATV told authorities that she turned onto a gravel portion of the road to avoid oncoming traffic and when she did so, she lost control of the ATV and it flipped over.
The most obvious cause of this girl's injuries is operator error. However, the design of ATV's have been implicated in many serious accidents, including rollover accidents. This is due to the fact that while they are four-wheeled vehicles, they have a high and unsteady center of gravity which leaves them prone to rollover accidents during the kind of maneuvers that the operator of this ATV undertook to avoid the oncoming traffic.
Anyone seriously injured as a result of an accident involving a dangerous piece of exercise or recreational equipment is strongly advised to make sure to preserve the remains of the equipment so that its condition following the accident can be properly documented. Further, experienced counsel should be contacted immediately so that the proper measures can be taken to document the scene of the accident. These measures are essential to preserving your rights against the manufacturer of the ATV or other piece of dangerous exercise or recreational equipment.
